Agreement

This AGREEMENT, made this_________day of__________________________ between the OCEAN GROVE MEMORIAL HOME, hereinafter known as the “funeral home” and the undersigned hereinafter known as the “purchaser” is for the funeral arrangements for: ________________ who resided at ______________________

As the purchaser will pay the CEMETERY at the time its services are rendered, those charges are not included in this agreement. The Funeral Home agrees to provide the Services, Transportation, Merchandise and Cash Advancements as described on the attached Statement of Funeral Goods and Services Selected. The total charges shown are estimated and reflect only those charges agreed upon up to the time this Agreement was made. Any additional service or item of merchandise ordered after the signing of this agreement will be reflected on our final statement which will be sent to the purchaser before payment is due.

As purchaser, I have examined the above noted items and have found them to be correct and in keeping with my desires. I authorize and order the above noted Services, Transportation, Merchandise and, in addition, the expenditure of Cash Advancements as estimated and I approve the charges therefore. I agree that the charge for any item of service or merchandise ordered by me subsequent to the signing of this agreement shall be considered as having been included in this agreement and it may be included on the final statement of charges by the funeral home. I am legally authorized to make these arrangements and I will hold the funeral home and funeral directors harmless from and indemnify them against any loss resulting from any claim made by another person because of these arrangements and this agreement. The liability hereby assumed by me is in addition to the liability imposed by law upon the estate but shall not constitute a release thereof. This agreement is the full understanding between us and it is a fair agreement. I have read and I understand the above statements. I hereby acknowledge receipt of a copy of this agreement and a copy of the Statement of Funeral Goods and Services Selected and I acknowledge that prior to all discussion of charges, I was provided with a printed GENERAL PRICE LIST which includes a CASKET PRICE LIST and a OUTER BURIAL ENCLOSURE PRICE LIST.

PAYMENT TERMS

1) The payment due to the place of final disposition IS NOT INCLUDED in these terms. Payment must be made directly to the cemetery by the purchaser on or before the day of final disposition. The funeral home will accept receipt of that payment and pass it along to the cemetery or Mausoleum.

2) The estimated amount of the funeral expense is $_________________________
If this payment, in full, is received by the funeral home on or before the day of the funeral, your account will be credited with a prompt payment discount in the amount of 3% of the merchandise purchased, (approx. $_____________________ ).
Any resulting overpayment will be returned to the payor once all charges have been finalized.

3) If the purchaser cannot or chooses not to make payment in full on or before the day of the funeral, a payment in the amount of............ $_________________ representing the estimated amount of the cash advancements plus one-third (1/3) of the total charges made by the funeral home must be paid to the funeral home on or before the day of final disposition. Payment in full of the balance due is required within THIRTY DAYS FROM THE DATE OF THE AGREEMENT.

We require the payment of the Full Estimated Amount or of the Partial Payment (as indicated above) on or before the day of final disposition.

OR

We require an acceptible Proof of Intention to Pay. Proof of Intention to Pay is a personal check in the Full Amount of the estimated expenses dated the day it is issued.. We will hold your check for an agreed time.

4) If the total charges are not paid in cash or by check at the arrangement conference, a PROMISSORY NOTE must be signed by the purchaser. If the charges by the funeral home are voluntarily paid by another person (or the estate) before the term of that note, the purchaser/ promissor is released from that obligation.

5) Payment may be made by means of:

Cash or check dated on the day it is issued. (We will hold your check for a limited time if you ask us to do so.)

We do not accept Visa, Mastercard, Discover or American Express directly. The funeral director will direct you to a bank which will issue a cash advance on your card if you have appropriate credit available.

The assignment of assignable benefits from individual (as opposed to group) life insurance policies, by the BENEFICIARY OF RECORD.

6) After our services are rendered, no contract will be renegotiated. The funeral home is not a lending institution; we do not include lending fees in our charges. We do not extend credit beyond thirty days.
